The long-awaited Agency Workers Regulations take effect in October 2011.

The new rules implement a European Directive ensuring that Agency Workers receive equal treatment on basic working and employment conditions when compared to the permanent employees and workers of the hiring organisation.

The entitlement to equal treatment takes effect once an agency worker has been supplied to the same hirer for a period of 12 weeks. Various measures have been incorporated into the regulations to prevent unscrupulous agencies and hirers from attempting to avoid their new obligations.

 

At the same time, a recent case BIS v Studders has added to the long list of case law that addresses the question of the legal status of agency workers - as regards their Agency or the Hiring employer.

 

So what legal issues are raised by the new regulations and this extensive case law for those organisations who use agency staff and what practical steps do employers need to take to address them?
