How buying property works in Scotland

Properties are typically advertised at offers over or fixed price, and where there is strong interest, a closing date may be set.
Most homes are marketed with a Home Report, which includes a survey, energy report and property questionnaire. This gives buyers a clear picture of the property before making an offer and helps reduce unexpected issues later on. Matters such as damp, roof condition or past alterations are usually highlighted upfront, allowing buyers to make informed decisions.
Making an offer
This is where we come in. We can submit both verbal and written offers on your behalf and advise you on the most appropriate offer to make, particularly in competitive situations. Once an offer is accepted, solicitors exchange formal letters known as missives to agree the final terms. When missives are concluded, the contract becomes legally binding.
Before making an offer, it’s important to have your funding lined up. A Decision in Principle from your lender gives you a clear idea of what you can afford and helps the process move quickly once your offer is accepted.
What your conveyancing solicitor does
Your conveyancing solicitor handles all the legal checks, including reviewing title deeds, boundaries, access rights, and any conditions affecting the property. They’ll also deal with your mortgage lender, prepare the paperwork, and make sure funds are transferred safely.
On the day you receive the keys, the purchase price is paid, ownership is transferred and the transaction is completed. Your solicitor then registers you as the new owner with the Land Register of Scotland.
