Waste firm Biffa is taking the Scottish Government to court in a bid to claim nearly £170million in damages over the collapse of the bottle return scheme.
The company argues the Scottish government was negligent in previously claiming the scheme, which was shelved in 2023, was viable.
But ministers, the BBC reports, insist Biffa Waste Services was aware of the risks.
Now, the case is to be heard at the Court of Session after a government bid to have the case thrown out earlier this year was rejected.
Due to get under way today, the case is scheduled to last around eight days.
The bottle return scheme had been due to start in August 2023 but was shelved just weeks before the launch following a dispute with the UK government.
In the wake of that, Circularity Scotland, the firm due to manage the project, collapsed with debts and liabilities totaling more than £86million.
Biffa Waste Services was one of its main creditors.
